TM Digital Media – Terms and Conditions

1. Introduction:
   By engaging TM Digital Media for web and development services, you agree to abide by the following terms and conditions.
2. Scope of Services:
   TM Digital Media will provide web design and development services as agreed upon with the client. Additional services may be provided upon request and agreement.
3. Client Responsibilities:
   Clients are responsible for providing necessary materials, content, and approvals in a timely manner. Delays caused by the client may impact project timelines.
4. Fees and Payments:
   Payment terms will be outlined in the project proposal. Failure to make timely payments may result in the suspension of services or project delays.
5. Intellectual Property:
   Upon full payment, the client owns the intellectual property rights to the developed website or digital product. TM Digital Media retains the right to display the project in its portfolio.
6. Project Timelines:
   Project timelines will be agreed upon before the commencement of work. Any changes to the scope or delays caused by unforeseen circumstances may impact the timeline.
7. Revisions and Changes:
   A specified number of revisions is included in the project scope. Additional revisions or changes may incur extra charges. Changes to the project scope will be documented and agreed upon by both parties.
8. Confidentiality:
   TM Digital Media agrees not to disclose any confidential information obtained during the project. The client agrees to keep confidential any proprietary information provided by TM Digital Media.
9. Termination of Services:
   Either party has the right to terminate services if the other party breaches the terms of the agreement. In such cases, fees for work completed and expenses incurred will be due.
10. Dispute Resolution:
    Any disputes arising from this agreement will be resolved through negotiation or, if necessary, through legal means in accordance with the laws of South Africa.
11. Amendments:
    TM Digital Media reserves the right to update or modify these terms and conditions. Clients will be notified of any changes, and continued use of services implies acceptance.
